1. Definitions 定义

1.1 “Personal Information” shall mean any kind of information related to an

identified or identifiable natural person as electronically or otherwise recorded that is provided by you to the Personal Information Processor, i.e. BASF Integrated Site (Guangdong) Co., Ltd., for the Purpose defined in this Statement, including but not limited to your name, gender, age, birth date, ID number, company department, company position, company email address, mobile phone number, photo, employee personnel number, employee card number, cost center, training record, work related certificates information, etc.

“个人信息” 是指由您提供给个人信息处理者，即巴斯夫一体化基地（广东）有限公司的、以电子方式或其他方式记录的、与已识别或者可识别的自然人有关的任何种类的信息，以用于声明中定义的目的，包括但不限于您的姓名、性别、年龄、出生日期、身份证号码、公司部门、公司岗位、公司邮箱、手机号码、照片、员工人事号码、员工卡号码、成本中心、培训记录、工作相关证书信息等。

1.2 “Collect and Process the Personal Information” includes but not limited to the collection, storage, use, process, transmission, provision, disclosure, and deletion of Personal Information.

“收集和处理个人信息”包括但不限于收集、储存、使用、处理、传输、提供、披露和删除个人信息。

1.3 “Personal Information Processor” shall mean BASF Integrated Site (Guangdong) Co. Ltd.

“个人信息处理者 ”是指巴斯夫一体化基地（广东）有限公司。

1.4 “Purpose”, as a basic principle (and as required by the Applicable Laws), Personal Information Processor only collects, stores, processes, uses and discloses Personal Information as required for a specified purpose. This means that for all collected, stored, processed, used and disclosed Personal Information, a well-defined purpose will be documented and made transparent to you by Personal Information Processor if your Personal Information is collected, stored, processed, used and disclosed. Personal Information Processor will collect, store, process, use and disclose your Personal Information hereby for the purpose of administration of the personnel who will use BASF Integrated Site Technical Training Accelerator System software, the operation and maintenance of the BASF Integrated Site Technical Training Accelerator System software, and the audits performed by competent government authority and/or BASF and its branches and affiliates.”

“目的”，作为一项基本原则（并根据适用法律的要求），个人信息处理者仅在为特定目的需要时，收集、储存、处理、使用和披露个人信息。这意味着，对于所有收集、储存、处理、使用和披露个人信息而言，如果收集、储存、处理、使用和披露您的个人信息，个人信息处理者将记录一个明确的目的，并且告知您。个人信息处理者将在此收集、储存、处理、使用和披露您的个人信息，以便对使用巴斯夫一体化基地技术培训引擎系统软件的人员进行管理，对巴斯夫一体化基地技术培训引擎系统软件进行运行和维护，以及政府主管机关和/或巴斯夫及其分支机构和关联公司进行的审计。

1.5 “Applicable Laws” including but not limited to Personal Information Protection Law of P. R. China, General Data Protection Regulation of Europe Union, and other laws and regulations of other countries which are applicable to the collection, storage, process, use and disclosure of the Personal Information hereunder.

“适用法律”包括但不限于《中华人民共和国个人信息保护法》、《欧盟通用数据保护条例》以及适用于本声明项下收集、储存、处理、使用和披露个人信息的其他国家的法律法规。

2. Collection, Storage, Process, Use and Disclosure of Personal Information 收集、储存、处理、使用和披露个人信息

2.1 Personal Information Processor will, in accordance with Applicable Laws, collect, store, process, use and disclose the Personal Information for the Purpose provided in this Statement.

个人信息处理者将根据适用法律，为本声明中规定的目的收集、储存、处理、使用和披露个人信息。

2.2 The methods for the collection of your Personal Information including but not limited to,

收集您的个人信息的方式包括但不限于，

  • l job application form before the you are formally recruited;

    • 在您被正式录用前的工作申请表格；

  • l your on-board related documents, e.g. labor contracts, etc.;

    • 您入职有关的文件，如劳动合同等；

  • l APP developed by a 3rd party but operated by Personal Information Processor;

    • 由第三方开发但由个人信息处理者运营的APP；

  • l Questionnaire arranged by Personal Information Processor;

    • 个人信息处理者安排的调查问卷

    2.3 Personal Information Processor will make sure that the Personal

    Information is only made available to those on a “need to know” basis and only to the extent necessary for the realization of Purpose.

    个人信息处理者将确保个人信息仅提供给那些 “需要知道”的人，并且只在实现目的必要的程度内提供。

    2.4 You are responsible for ensuring that your Personal Information provided to the Personal Information Processor is accurate, complete and not misleading. Further, if there is any update to your Personal Information, you should immediately provide the Personal Information Processor with the aforesaid updates.

    您有责任确保您提供给个人信息处理者的个人信息是准确、完整和没有误导的。此外，如果您的个人信息有任何更新，您应立即向个人信息处理者提供上述个人信息更新。

    2.5 You are entitled to refuse to provide Personal Information Processor with Personal Information. However, if you refuse to provide Personal Information Processor with certain Personal Information, you may not be able to use the products, services, trainings, and treatment, etc. offered by Personal Information Processor, or it may have some negative impacts to your enjoyment of the aforesaid products, services, trainings, and treatment, etc.

    您有权拒绝向个人信息处理者提供个人信息。然而，如果您拒绝向个人信息处理者提供特定个人信息，您可能无法使用个人信息处理者提供的产品、服务、培训和待遇等，或可能对您享受上述产品、服务、培训和待遇等产生一些负面影响。

    2.6 For your rights and interests, you hereby agree that the Personal Information Processor could collect, store, process, use and disclose your Personal Information in the following methods,

    为了您的权利和利益，您在此同意，个人信息处理者可以通过以下方式收集、储存、处理、使用和披露您的个人信息。

  • l For the performance of labor contracts and/or the implementation of human resource management and/or Personal Information Processor (including Personal Information Processor’s branches and affiliates) related businesses;

    • 为履行劳动合同和/或实施人力资源管理和/或个人信息处理者（包括个人信息处理者的分支机构和关联公司）的相关业务；

  • l Personal Information Processor could disclose and authorize Personal Information Processor’s branches and affiliates to collect, store, process, use and disclose your Personal Information;

    • 个人信息处理者可以披露并授权个人信息处理者的分支机构和关联公司收集、储存、处理、使用和披露您的个人信息；

  • l Within the normal scope of business operation, Personal Information Processor and its branches and affiliates are entitled to disclose and authorize their assignees, successors, legal and finance counsel, external goods and/or services suppliers to collect, store, process, use and disclose your Personal Information;

    • 在正常的业务运作范围内，个人信息处理者及其分支机构和关联公司有权披露并授权其受让人、继承人、法律和财务顾问、外部货物和/或服务供应商收集、储存、处理、使用和披露您的个人信息；

    2.7 For your rights and interests, Personal Information Processor may provide your Personal Information to third parties under the following circumstances,

    为了您的权利和利益，个人信息处理者可能会在以下情况下将您的个人信息提供给第三方，

  • l To secure the compliance with relevant Applicable Laws;

    • 确保遵守相关的适用法律；

  • l To satisfy the compulsory requirements of government authorities (including judicial authorities) and arbitration commission;

  • l To enforce the terms and conditions of contract;

  • l To investigate, prevent or handle security, technical and compliance issues;

  • l To your emergency contact person for the protection of your rights and interests in an emergency case;

  • l Other circumstances permitted under Applicable Laws;

    • 适用法律项下允许的其他情形；

    3. Protection of Personal Information 个人信息的保护

    3.1 The Personal Information Processor will strictly protect the security of your Personal Information. Personal Information Processor will use appropriate systems, security technologies and procedures to protect your Personal Information from unauthorized access, use or disclosure. Personal Information Processor will also cause each recipient and user to use its diligent efforts to protect and not disclose your Personal Information.

    个人信息处理者将严格保护您个人信息的安全。个人信息处理者将使用适当的系统、安全技术和程序来保护您的个人信息，防止未经授权的访问、使用或披露。个人信息处理者还将促使每一个个人信息接收者和使用者，尽其勤奋努力，保护和不披露您的个人信息。

    4. Waiver of Liability 责任免除

    4.1 To the fullest extent permitted by Applicable Laws, in respect of the collection, storage, process, use and disclosure of your Personal Information under this Statement, you hereby forever release, discharge and waive Personal Information Processor and each of its branches and affiliates and its employees from and against any and all actions, claims, demands, damages, obligations, liabilities, disputes and enforcement in connection with the aforesaid collection, storage, process, use and disclosure of your Personal Information, whether such actions, claims, demands, damages, obligations, liabilities, disputes and enforcement by way of breach of contract, tort, strict liability or other legal theory.

    在适用法律允许的最大范围内，对于在本声明项下收集、存储、处理、使用和披露您的个人信息，您在此永远免责、免除和放弃针对个人信息处理者及其每个分支机构和关联公司及其雇员的任何和所有诉讼、索赔、要求、损害赔偿、义务、责任、争议和强制执行。前述任何和所有诉讼、索赔、要求、损害赔偿、义务、责任、争议和强制执行与上述收集、储存、处理、使用和披露您的个人信息有关，无论这些诉讼、索赔、要求、损害赔偿、义务、责任、争议和强制执行是通过违约、侵权、严格责任或其他法理提出的。

    5. Retention Period of Personal Information 个人信息的保存期间

    5.1 Unless otherwise stipulated by Applicable Laws or agreement, the retention period of your Personal Information is the minimum period necessary for achieving the Purpose, and the Personal Information Processor is entitled to adjust it according to its actual needs and necessity.

    除非适用法律或协议另有规定，员工个人信息的保存期限为实现目的所必要的最短时间，并且个人信息处理者有权根据其实际需要和必要性进行调整。

    6. Cross Boarder Transfer of Personal Information 跨境传输个人信息

    6.1 Since the location of business of the Personal Information Processor and its affiliates are not limited to the People’s Republic of China, and the employees of Personal Information Processor and its affiliates are not limited to Chinese citizen, in order to facilitate the global and unified management of data by the group company and to achieve the purposes of personal information processing described in this Statement, subject to the Applicable Laws, the Personal Information Processor may transfer your Personal Information outside the People's Republic of China and share them with Personal Information Processor’s overseas affiliates. For the avoidance of doubt, Personal Information Processor will transfer your Personal Information outside the People's Republic of China only if it is necessary for the realization of the specific Purpose. The Personal Information Processor will perform the cross-border transfer of your Personal Information in accordance with the laws and regulations of People's Republic of China.

    因个人信息处理者及其关联公司的业务不限于中华人民共和国境内，且个人信息处理者及其关联公司的员工也不限于中国公民，为了便于集团公司对数据进行全球统一管理，并实现本声明所述的个人信息处理目的，在遵守适用法律的前提下，个人信息处理者可能将您的个人信息转移到中华人民共和国境外，并与个人信息处理者的海外关联公司共享。为避免疑问，个人信息处理者将仅在为实现特定目的所必需的情况下才会将您的个人信息转移到中华人民共和国境外。个人信息处理者将根据中华人民共和国的法律法规，对您的个人信息进行跨境转移。

    7. Effectiveness 有效性

    7.1 The Statement shall be effective as of the date you tick “ I hereby agree and fully authorize the Personal Information Processor to collect, store, process, use and disclose of my personal information for the purpose of administration of the personnel who will use BASF Integrated Site Technical Training Accelerator System software, the operation and maintenance of the BASF Integrated Site Technical Training Accelerator System software, and the audits performed by competent government authority and/or BASF and its branches and affiliates. ” and/or click “I agree with this Statement and enter this APP.” at the bottom of the Statement.

    声明应自您勾选“我在此同意并完全授权个人信息处理者收集、储存、处理、使用和披露我的个人信息，以便对使用巴斯夫一体化基地技术培训引擎系统软件的人员进行管理，对巴斯夫一体化基地技术培训引擎系统软件进行运行和维护，以及政府主管机关和/或巴斯夫及其分支机构和关联公司进行的审计。” 和/或点击声明底部的“本人同意本声明并进入本APP。”之日起生效。

    7.2 After you tick “I hereby agree and fully authorize the Personal Information Processor to collect, store, process, use and disclose of my Personal Information for the purpose of administration of the personnel who will use BASF Integrated Site Technical Training Accelerator System software, the operation and maintenance of the BASF Integrated Site Technical Training Accelerator System software, and the audits performed by competent government authority and/or BASF and its branches and affiliates. ” and/or click “I agree with this Statement and enter this APP.” at the bottom of the Statement, your consent and authorizations granted under this Statement shall be treated as also granted for those collection, storage, process, use and disclosure of your Personal Information (if any) before the effective date of this Statement.

    在您勾选“我在此同意并完全授权个人信息处理者收集、储存、处理、使用和披露我的个人信息，以便对使用巴斯夫一体化基地技术培训引擎系统软件的人员进行管理，对巴斯夫一体化基地技术培训引擎系统软件进行运行和维护，以及政府主管机关和/或巴斯夫及其分支机构和关联公司进行的审计。”和/或点击声明底部的“本人同意本声明并进入本APP。”后，您根据本声明授予的同意和授权，应被视为对那些在本声明生效日前就您的个人信息进行的收集、储存、处理、使用和披露行为（如有），也进行了同意和授权。

    8. Miscellaneous 其他条款

    8.1 Subject to Applicable Laws, the changes to the Applicable Laws and/or the changes to Personal Information Processor’s business operations, the Personal Information Processor is entitled to revise and/or supplement this Statement at any time after the effective date of this Statement. The updated Statement will be released again for your reading and confirmation.

    服从于适用法律，适用法律的变化和/或个人信息处理者业务运营的变化，个人信息处理者有权在本声明的生效日后任何时候修订和/或补充本声明。更新后的声明将再次发布供您阅读和确认。

    8.2 If any provision of this Statement is found by any court or national authority of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions of this Statement which shall remain in full force and effect, and Personal Information Processor will adjust the language of the provisions of this Statement to obtain a result similar to that originally intended by Personal Information Processor.

    如果本声明的任何条款被任何有管辖权的法院或国家机关认定为无效或不可执行，该等无效或不可执行不应影响本声明的其他条款，该等其他条款应保持充分的效力和作用，并且个人信息处理者将调整本声明的条款语言，以获得与个人信息处理者最初意图相似的结果。

    8.3 This Statement is prepared in Chinese and English version. The English and Chinese version of this Statement shall have same effect.

    本声明以中文和英文版本编写。本声明的英文和中文版本具有同等效力。

    9. Help帮助

    If you become aware of any error and/or omission in the collection, storage, process, use and disclosure of your Personal Information, or if you have any doubts as to whether certain procedures for the collection, storage, process, use and disclosure of your Personal Information comply with the Applicable Laws, please speak up and contact your manager, the legal experts, your local helpdesk or the Data Protection Officer directly.

    如果您发现在收集、储存、处理、使用和披露您的个人信息过程中有任何错误和/或遗漏，或者您对收集、储存、处理、使用和披露您的个人信息的特定程序是否符合适用法律有任何疑问，请做出表达并直接联系您的经理、法律专家、当地服务台或数据合规官。
